Additional Info on notifying the
Chief Law Enforcement Officer
("CLEO")
Every time you buy or build a Silencer or SBR, you are required to send a copy of your ATF Application to the CLEO where the Silencer or SBR will be stored. Additionally, you and the other Responsible Persons in your trust (if any) are required to send a copy of your Form 23 (Responsible Person Questionnaire) to the CLEO of the area where each of the RPs live.
So who is the CLEO?
According to the ATF, the chief law enforcement officer is considered to be the Chief of Police; the Sheriff; the Head of the State Police; or a State or local district attorney or prosecutor.
So that seems pretty straight forward, and in most cases it is. Especially if the address where you store the Silencer or SBR is the same as your home address, and if you don’t have any additional Responsible Persons in your Gun Trust.
But what if the situation is more complicated?
The following hypothetical scenario provides a good example of how the issue can be much more complicated:
Jack lives in Phoenix Arizona. He is using his Arizona Gun Trust to buy a Silencer, but he is going to keep the silencer at his hunting ranch located in El Paso, Texas. To make matters even more confusing, his buddies Jim & John are Responsible Persons on the Gun Trust. Jim lives in Palm Beach, Florida and John lives in Vegas.
So which CLEO does Jack use?
 
The Form 1 (or Form 4)
The Form 1 Application must be sent to the CLEO of the area where the Silencer will be stored a majority of the time.
Because Jack will be keeping the Silencer at the El Paso hunting ranch, he needs to send the CLEO Copy of the Form 1 Application to one of the following agencies that has jurisdiction over the area where the ranch is located:
El Paso Police Department (but only if Silencer will be stored within the city limits of El Paso)
El Paso County Sheriff’s Office
El Paso County District Attorney’s Office
Texas Department of Public Safety (Highway Patrol)
United States Attorney’s Office for the Western District of Texas
Jack’s Form 23
However, the CLEO Copy of Jack’s Form 23 Responsible Person Questionnaire must be sent to the CLEO of the area where he lives. Because Jack lives in Phoenix Arizona, he can send his Form 23 to one of the following agencies with jurisdiction over the area where he lives:
Phoenix Police Department,
Maricopa County Sheriff’s Office,
Arizona Department of Public Safety
United States District Attorney for the District of Arizona
Maricopa County Attorney’s Office
Jim’s Form 23
Jim needs to send his Form 23 to one of the CLEO agencies with jurisdiction over Palm Beach County, Florida. It can be his local Police Department, Sheriff’s Office, or Prosecuting Attorney. Or, it can be one of the state agencies such as the Highway Patrol, or State District Attorney.
John’s Form 23
The same is true for John. He needs to send his Form 23 to one of the CLEO agencies with jurisdiction over the area where he lives in Clark County Nevada. It can be his local Police Department, Sheriff’s Office, or Prosecuting Attorney. Or, it can be one of the state agencies such as the Highway Patrol, or State District Attorney.
